Prop 65 Compliance

Did you know Prop 65 compliance is evolving? The California Office of Environmental Health Hazard Assessment (OEHHA) requires businesses to provide warnings about significant exposures to chemicals that cause cancer, birth defects or other reproductive harm. As new information is added to Prop 65, your business may need an experienced regulatory consultant to help assure compliance.

California Prop 65, officially known as the Safe Drinking Water and Toxic Enforcement Act, was passed in 1986 and has been receiving revisions continually since. As of August 30, 2018, the California Attorney General’s Office has been enforcing these labeling and disclosure requirements. The state is required to update and maintain a list of chemicals known to them to cause cancer or reproductive toxicity or be at risk of warnings and fines. Compliance to these regulations is needed to avoid litigation or disruption of product sales in the state.
